They apply differently depending on whether an organisation is acting as a provider or a deployer of an AI system and on how the technology is being used.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">For businesses, this distinction matters.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The AI Act does not create a single rule stating that every use of generative AI must be disclosed. Instead, Article 50 establishes specific transparency obligations for particular systems and use cases.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">That means companies need more than a generic \u201cAI-generated\u201d label.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">They need to understand where AI is being used, what role they play under the Regulation and which transparency obligation applies.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Here are five areas businesses should address now.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity ext-animate--on\"\/>\n\n\n\n<h2 class=\"wp-block-heading ext-animate--on\">1. Identify where people are interacting directly with AI<\/h2>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">One of the most visible requirements concerns AI systems that interact directly with people.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Under Article 50(1), providers must ensure that AI systems intended to interact directly with natural persons are designed and developed so that those individuals are informed that they are interacting with an AI system.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">There is an exception where this would already be obvious to a reasonably well-informed, observant and circumspect person in the circumstances. The European Commission has indicated that this exception should be interpreted restrictively.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Examples of potentially relevant systems include:<\/p>\n\n\n\n<ul class=\"wp-block-list ext-animate--on\">\n<li class=\"ext-animate--on\">customer-service chatbots;<\/li>\n\n\n\n<li class=\"ext-animate--on\">conversational AI assistants;<\/li>\n\n\n\n<li class=\"ext-animate--on\">AI agents communicating directly with customers;<\/li>\n\n\n\n<li class=\"ext-animate--on\">virtual avatars;<\/li>\n\n\n\n<li class=\"ext-animate--on\">other interactive AI interfaces that communicate directly with individuals.<\/li>\n<\/ul>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The Commission\u2019s guidance explains that the rule applies where there is a genuine direct interaction between the AI system and a natural person. Systems operating only in the background or through machine-to-machine communication do not fall within this particular disclosure obligation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading ext-animate--on\">What businesses should do<\/h3>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Create an inventory of customer-facing and employee-facing interactive AI systems.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">For each system, establish:<\/p>\n\n\n\n<ul class=\"wp-block-list ext-animate--on\">\n<li class=\"ext-animate--on\">who provides the AI system;<\/li>\n\n\n\n<li class=\"ext-animate--on\">whether users interact directly with it;<\/li>\n\n\n\n<li class=\"ext-animate--on\">whether the AI nature of the interaction is already obvious;<\/li>\n\n\n\n<li class=\"ext-animate--on\">how and when the disclosure is presented;<\/li>\n\n\n\n<li class=\"ext-animate--on\">whether the information is accessible and clearly distinguishable.<\/li>\n<\/ul>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The Commission states that people should be informed from the beginning of the first interaction where the requirement applies.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">A company should therefore not wait until the end of an AI-assisted conversation to explain that AI was involved.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity ext-animate--on\"\/>\n\n\n\n<h2 class=\"wp-block-heading ext-animate--on\">2. Understand the difference between visible disclosure and machine-readable marking<\/h2>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Article 50 contains two concepts that businesses should not confuse.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">One concerns what people can see or understand.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The other concerns what machines can detect.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Providers of AI systems, including general-purpose AI systems, that generate synthetic audio, image, video or text content must ensure that relevant outputs are marked in a machine-readable format so that they can be detected as artificially generated or manipulated.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The Regulation requires these technical solutions to be effective, interoperable, robust and reliable as far as technically feasible, taking account of factors including the type of content, implementation costs and the state of the art.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">However, this does not mean that every AI-assisted edit automatically falls within the marking requirement.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Article 50 provides an exception where an AI system performs an assistive function for standard editing or does not substantially alter the input data or its meaning. The Commission\u2019s guidance also provides further examples and clarification concerning outputs that fall outside the obligation.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">This is particularly relevant for companies using AI-enabled creative, marketing and productivity tools.<\/p>\n\n\n\n<h3 class=\"wp-block-heading ext-animate--on\">What businesses should do<\/h3>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">When procuring or deploying generative AI systems, ask providers:<\/p>\n\n\n\n<ul class=\"wp-block-list ext-animate--on\">\n<li class=\"ext-animate--on\">Does the system generate synthetic text, audio, images or video?<\/li>\n\n\n\n<li class=\"ext-animate--on\">Does it implement the machine-readable marking required by Article 50?<\/li>\n\n\n\n<li class=\"ext-animate--on\">What technical method is used?<\/li>\n\n\n\n<li class=\"ext-animate--on\">Is the marking preserved when content is exported?<\/li>\n\n\n\n<li class=\"ext-animate--on\">Are there workflows that may remove relevant metadata or other markings?<\/li>\n\n\n\n<li class=\"ext-animate--on\">Which outputs are treated as outside the Article 50(2) requirement?<\/li>\n<\/ul>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Procurement and technology teams should make these questions part of AI vendor due diligence rather than leaving them exclusively to marketing or legal departments.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity ext-animate--on\"\/>\n\n\n\n<h2 class=\"wp-block-heading ext-animate--on\">3. Establish a clear policy for deepfakes<\/h2>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Deepfakes receive specific treatment under Article 50.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The AI Act defines a deepfake as AI-generated or manipulated image, audio or video content that resembles existing persons, objects, places, entities or events and would falsely appear to a person to be authentic or truthful.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Where an organisation acting as a deployer uses an AI system to generate or manipulate image, audio or video content that constitutes a deepfake, Article 50(4) requires disclosure that the content has been artificially generated or manipulated.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The disclosure must be clear and distinguishable and must be provided no later than the person&#8217;s first exposure to the content. The Commission has specifically explained that a deployer cannot rely solely on an invisible machine-readable mark to satisfy this human-facing disclosure requirement.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">There is a tailored rule for content forming part of evidently artistic, creative, satirical, fictional or analogous works or programmes. In such cases, disclosure is still required, but it may be provided in an appropriate manner that does not interfere with the display or enjoyment of the work.<\/p>\n\n\n\n<h3 class=\"wp-block-heading ext-animate--on\">What businesses should do<\/h3>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Marketing, communications and creative teams should establish a review process for AI-generated or AI-manipulated:<\/p>\n\n\n\n<ul class=\"wp-block-list ext-animate--on\">\n<li class=\"ext-animate--on\">photographs;<\/li>\n\n\n\n<li class=\"ext-animate--on\">advertisements;<\/li>\n\n\n\n<li class=\"ext-animate--on\">promotional videos;<\/li>\n\n\n\n<li class=\"ext-animate--on\">synthetic voices;<\/li>\n\n\n\n<li class=\"ext-animate--on\">virtual presenters;<\/li>\n\n\n\n<li class=\"ext-animate--on\">realistic representations of people, products, locations or events.<\/li>\n<\/ul>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The key question is not simply:<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">\u201cWas AI used?\u201d<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">It is:<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\"><strong>Does the content meet the AI Act definition of a deepfake, and if so, how must it be disclosed?<\/strong><\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">That distinction prevents both under-disclosure and unnecessary blanket labelling.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity ext-animate--on\"\/>\n\n\n\n<h2 class=\"wp-block-heading ext-animate--on\">4. Treat AI-generated public-interest text differently from ordinary business content<\/h2>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Another frequently misunderstood provision concerns AI-generated text.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Article 50 does not say that every email, product description, social-media post or marketing text created with AI must automatically carry an AI label.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The specific disclosure obligation applies to AI-generated or manipulated text that is&nbsp;<strong>published for the purpose of informing the public on matters of public interest<\/strong>.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The Commission identifies examples of public-interest subject matter including areas such as:<\/p>\n\n\n\n<ul class=\"wp-block-list ext-animate--on\">\n<li class=\"ext-animate--on\">politics and democratic processes;<\/li>\n\n\n\n<li class=\"ext-animate--on\">public administration;<\/li>\n\n\n\n<li class=\"ext-animate--on\">justice and law enforcement;<\/li>\n\n\n\n<li class=\"ext-animate--on\">fundamental rights;<\/li>\n\n\n\n<li class=\"ext-animate--on\">public security;<\/li>\n\n\n\n<li class=\"ext-animate--on\">public health;<\/li>\n\n\n\n<li class=\"ext-animate--on\">environmental protection;<\/li>\n\n\n\n<li class=\"ext-animate--on\">consumer safety;<\/li>\n\n\n\n<li class=\"ext-animate--on\">economic, financial, scientific and cultural developments relevant to public debate.<\/li>\n<\/ul>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">There is also an important exception.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Disclosure is not required under this provision where the AI-generated text has undergone a process of human review or editorial control&nbsp;<strong>and<\/strong>&nbsp;a natural or legal person holds editorial responsibility for its publication.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">The Commission further clarifies that meaningful human review involves substantive examination by a person with relevant knowledge and professional judgement. Merely checking spelling or grammar is not enough to constitute the type of human review described in its guidance.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">This distinction is highly relevant for corporate publishing.<\/p>\n\n\n\n<h3 class=\"wp-block-heading ext-animate--on\">What businesses should do<\/h3>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Establish an editorial workflow for AI-assisted public communications.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">For higher-risk or public-interest material:<\/p>\n\n\n\n<ol class=\"wp-block-list ext-animate--on\">\n<li class=\"ext-animate--on\">Identify whether generative AI was used.<\/li>\n\n\n\n<li class=\"ext-animate--on\">Verify factual claims against authoritative sources.<\/li>\n\n\n\n<li class=\"ext-animate--on\">Conduct substantive human review.<\/li>\n\n\n\n<li class=\"ext-animate--on\">Record who approved the content.<\/li>\n\n\n\n<li class=\"ext-animate--on\">Establish who holds editorial responsibility.<\/li>\n\n\n\n<li class=\"ext-animate--on\">Determine whether an Article 50 disclosure is required.<\/li>\n<\/ol>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">This approach is stronger than simply adding \u201cCreated with AI\u201d to everything a company publishes.<\/p>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">It creates accountability.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity ext-animate--on\"\/>\n\n\n\n<h2 class=\"wp-block-heading ext-animate--on\">5. Audit disclosures<\/h3>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Check whether required AI interaction notices and content disclosures are clear, distinguishable, timely and accessible.<\/p>\n\n\n\n<h3 class=\"wp-block-heading ext-animate--on\">4. Review vendors<\/h3>\n\n\n\n<p class=\"ext-animate--on wp-block-paragraph\">Confirm how AI suppliers implement machine-readable marking and other Article 50 functionality relevant to their systems.<\/p>\n\n\n\n<h3 class=\"wp-block-heading ext-animate--on\">5.
